A. INTRODUCTION AND OUR ROLE

A.1 Company details
Ordering services are offered by appyepos Ltd. appyepos is registered in England and Wales. Company registration number : 14253427

A.2 Service
appyepos is a epos and web , app creator and takeaway ordering service provider acting as an intermediary between independent restaurants, takeaway food outlets and customers.

 

B. APP / WEBSITE ACCESS AND TERMS
B.1 App / Website access
You may access some areas of the App without registering your details with us. Most areas of the App are open to everyone. You must register to place an order.

B.2 Acceptance of terms
By accessing any part of the Website and app, you indicate that you accept our terms. If you do not accept our terms and conditions, you should close the app immediately, and you will not be able to place order.

B.3 Accountability
You are responsible for making all arrangements necessary for you to have access to the app / website. You are also responsible for ensuring that all persons who access the app / website through your Internet connection are aware of our Terms and conditions, and that they comply with them.

 

C. DECLARATION
By registering and placing an order through our app / website, you assure that :

C.1 We may use your personal data to inform you of special offers and new or existing services that we believe may be of interest to you or to send surveys or questionnaires so that we can learn more about your needs and interests and better our service.

C.2 We may use personal data to notify you about your order status and / or progress, other matters related to your use of our services, important information regarding the app / website or changes to our terms, conditions, and policies.

 

D. PLACING AND ORDER AND PROCESSING
D.1 Placing order
Once you have added the products to the shopping cart / bag you wish to order from the menu of Foleys Fish Bar, 89 Stourport Road, Kidderminster, DY11 7BQ and provided the other required information, you will be given the opportunity to submit your order by clicking on “place order” or similar button. It is important that you check all the information that you enter and correct any errors before clicking this button; once you do so we will start processing your order and errors cannot be corrected.

D.2 Amending or cancelling your order
Once you have placed your order and your payment has been authorised (in case of card payment), you will have very little time to amend or cancel your order and get refund. If you wish to change or cancel your order, you need to contact Foleys Fish Bar directly. However, there is no guarantee that you will be able to amend or cancel order as they may have already started processing your order. If Foleys Fish Bar cancels your order then you will receive refund (partial or full) within 2 to 3 working days to the card used at the time of placing your order.

D.3 Order processing and rejections
On receipt of your order, we will begin processing it by sending it to Foleys Fish Bar and will notify you by email or APP push notification that your order has been received and is being processed. Please note that any confirmation that you see on the Website and any order confirmation e-mail that you may receive each merely indicate that your order has been received and is being processed by us, and does not necessarily mean that your order has been accepted by Foleys Fish Bar. Foleys Fish Bar has the discretion to reject any order at any time because they are too busy, due to weather conditions or for any other reason. If Foleys Fish Bar rejects your order, you will be notified by email, APP push notification and status update on the APP / website and money will be refunded (in case of card payment).

D.4 Collection of your Order
Estimated times for collections are provided by Foleys Fish Bar and are only estimates. Neither we nor Foleys Fish Bar guarantee that your order will be available for collection within the estimated times.

 

E. PRICE AND PAYMENT
E.1 Incorrect pricing
This Website contains a huge number of menus and it is possible that some of the menus may include incorrect prices. In such an event, neither we nor Foleys Fish Bar is under any obligation to ensure that the order is provided to you at the incorrect price or to compensate you in respect of incorrect pricing.

E.2 Payment methods
Payment for orders must be made by an accepted payment method (Stripe, credit or debit card) through the App or in cash to Foleys Fish Bar at the point of delivery to you or collection.

E.3 Card payments
If you pay by credit or debit card, you may be required to show the card to Foleys Fish Bar at the time of delivery as proof of identification and so that they can check that the card conforms with the receipt data for the order. Please note that from time to time there may be delays with the processing of card payments and transactions.

E.4 Credit and discount vouchers
A credit or discount may apply to your order if you use a promotional voucher or code recognised by the App and endorsed by Foleys Fish Bar.
